Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of Apogea Lodge (apogealodge.com) and related services (collectively, the "Service"). By accessing or using the Service, you agree to these Terms and our Privacy Policy.

If you do not agree, do not use the Service. We may update these Terms from time to time. Continued use after changes are posted constitutes acceptance of the revised Terms.

2. About Apogea Lodge

Apogea Lodge is an unofficial, community-made companion website for players of the upcoming MMORPG Apogea. The Service provides tools and community features such as build planning, a compendium, calculators, news, forum discussions, and comments.

The Service is operated by Raphael da Silva Jacuá, an individual based in Portugal. Community features are free to use. We do not sell subscriptions or paid accounts on the Service itself.

3. Non-Affiliation Disclaimer

Apogea Lodge is not affiliated with, endorsed by, or sponsored by Trinitas or any official Apogea development team.

Apogea, Trinitas, and related names, logos, images, and game assets are the property of their respective owners. Our use of game-related materials is for non-commercial, informational, and community purposes. We make no claim of ownership over official game intellectual property.

4. Eligibility

You must be at least 13 years old to use the Service. If you are under the age required to consent to online services in your country, you may use the Service only with verifiable parental or guardian consent.

You are responsible for ensuring that your use of the Service complies with applicable laws in your location.

5. Accounts and Authentication

Certain features require a lodge account. Sign-in is provided through third-party OAuth providers (Google, GitHub, and/or Discord). We receive information from those providers as described in our Privacy Policy.

You are responsible for activity under your account and for maintaining the security of the provider account used to sign in. Notify us promptly at privacy@apogealodge.com if you believe your account has been compromised.

6. Acceptable Use

We may remove content or suspend accounts that violate these rules or that we reasonably believe harm the community or the Service.

• Do not harass, threaten, defame, or discriminate against others.
• Do not post spam, scams, malware links, or misleading content.
• Do not upload or share illegal content or content that infringes third-party rights.
• Do not impersonate other users, Trinitas staff, or official Apogea representatives.
• Do not promote cheating, exploits, account sharing, or unauthorized game modifications in ways that violate applicable game rules.
• Do not attempt to disrupt, scrape, overload, or reverse engineer the Service.
• Do not use the Service for unlawful purposes.

7. User-Generated Content

You may submit content such as builds, forum posts, comments, and profile information ("User Content"). You retain ownership of your original User Content.

By submitting User Content, you grant Apogea Lodge a non-exclusive, worldwide, royalty-free license to host, display, reproduce, and distribute that content solely to operate and promote the Service. This license ends when the content is deleted, except where retention is required by law or where public community content has been anonymized after account deletion as described in our Privacy Policy.

You represent that you have the rights needed to submit your User Content and that it does not violate these Terms or applicable law.

8. Content Accuracy and "As Is" Use

Game data, builds, guides, and community posts may be incomplete, outdated, or based on playtests. The Service is provided for informational and planning purposes only.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Moderation and Termination

We may monitor, edit, remove, or restrict User Content and may suspend or terminate access to the Service at our discretion, with or without notice, for conduct that violates these Terms or is otherwise harmful.

You may delete your account at any time from your profile settings or by contacting privacy@apogealodge.com.

10. Monetization and Voluntary Support

Access to core community features remains free. In the future, the Service may display third-party advertising and may link to external support platforms such as Patreon or Ko-fi.

Donations and external memberships are voluntary. They do not guarantee perks, privileged access, moderation influence, or official status. Payments made through Patreon, Ko-fi, or similar platforms are governed by those platforms' own terms and privacy policies.

When advertising is introduced, we will update these Terms and our Privacy Policy as needed. Advertising content is the responsibility of the relevant advertiser or ad network.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Raphael da Silva Jacuá and Apogea Lodge shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or other intangible losses arising from your use of the Service.

Nothing in these Terms limits liability that cannot be limited under mandatory law, including consumer rights where applicable.

12. External Links

The Service may link to third-party websites and communities (for example Discord, YouTube, Patreon, or Ko-fi). We are not responsible for the content, policies, or practices of third-party sites. Use them at your own risk.

13. Governing Law

These Terms are governed by the laws of Portugal, without regard to conflict-of-law rules. Courts in Portugal shall have jurisdiction where permitted by law.

If you are located in the European Union, Brazil, or certain U.S. states, you may have additional mandatory rights under GDPR, LGPD, CCPA, or other local laws. Nothing in these Terms limits those rights.
